Cold email compliance means following the privacy, marketing and platform rules that apply to your campaign. Requirements depend on the countries involved, the recipient and how you obtained their information.
Before launch
- Check whether consent or another permission is required.
- Use a truthful identity, subject and message.
- Provide the required sender details and an easy opt-out.
- Keep opted-out contacts suppressed across campaigns.
- Handle contact data securely and provide required privacy information.
US CAN-SPAM, UK PECR and data-protection rules, EU national marketing laws and Canada's CASL do not have identical requirements. A business email address does not automatically create an exemption. Relevant targeting and an opt-out are not a substitute for checking the applicable rules.
Use the FTC's US guidance and ICO electronic-mail guidance as starting points. This overview is not legal advice; get advice for your jurisdiction and campaign.
